Recreational Open Burn
The Fire Site must be a distance of at least 25 feet to all buildings including: Neighbors house, Roadway and property lines.
RECREATIONAL OPEN BURN CONSTRUCTED ON THE GROUND SHOULD ONLY BE USED FOR COOKING OF FOOD, PLEASURE, WARMTH OR SIMULAR USE.
A BON FIRE CONSTRUCTED ON THE GROUND IS FOR CEREMONIAL PURPOSES AND REQUIRES A PERMIT.
ALL OTHER BURNING WILL BE CONSIDERED ILLEGAL BY THE REGIONAL AIR POLLUTION CONTROL AGENCY (E.P.A)
Burning must comply with the conditions listed below per the Ohio Fire Code and is outlined by the EPA.
302.1 – The burn site should be contained in a manner smaller than 3 ft x 3 ft x 2 ft high.
307.1.1 – Do not burn during adverse atmospheric conditions such as high wind and/or dry conditions
307.3 – The fire must not create a nuisance or be offensive to others (i.e. neighbors) and may be extinguished by the Fire Department if the fire creates a hazard or objectionable situation.
307.4.2 – Recreational Fires must be at least 25 feet from any structure or building.
307.5 – The fire shall be constantly attended until extinguished and fire extinguisher equipment shall be available for immediate use at fire site. (i.e. a bucket of water or garden hose or suitable size type of fire extinguisher)
307.2 – If a Bon Fire is desired then a permit shall be required. Contact Chief Mike Blackwell with the Union Fire Department at (937) 836-0912.
307.2.1 – All other open burning shall be regulated through the Regional Air-Pollution Control Agency (R.A.P.C.A.) 937-255-4435.
The burning of leaves, trash, grass or rubbish is prohibited by the Ohio EPA and RAPCA. Only dry well seasoned wood shall be burned.
The attendant and property owner should be aware of the conditions listed above. Failure to comply with the provisions and conditions as set forth may be cause for legal action against the property owner. This notification is not a permit and does not imply the Union Fire Department has inspected the proposed burn site nor assumes any responsibility or liability for any damages caused by the open burning. The Union Fire Department reserves the right to extinguish any fire that fails to meet the above conditions of the Fire Code or that which creates an unsafe, dangerous or nuisance condition or as directed by the Regional Air-Pollution Control Agency (RAPCA).
Burning may also be suspended upon unfavorable weather or environmental conditions.
All other burning for the disposal of tree limbs, brush and other yard waste shall first obtain a permit from the Regional Air- Pollution Control Agency and can be contacted by phone at (937 225-4435 or on the web.
